In 2023 Migoubcn will be 10 years since my wife and I started to manage the idea of creating a brand related to cycling, it really took 2 years before we started, as there were many things to prepare.
We are still a family business and very small but with the same enthusiasm as 10 years ago and within our means we are going to make some gifts during 2023.
LEGAL BASES OF THE PROMOTION
International Sweepstakes
The draw is valid internationally, the products of our brand will be sent by ordinary mail to any country but we only guarantee delivery in mainland Spain, as there are countries that can not be sent liquids, creams etc. by ordinary mail or you have to make an export of product.
For example, liquids cannot be sent to the Canary Islands by post from the mainland.
If we are unable to use the Spanish postal service Correos (https://www.correos.es/) it is the winner’s responsibility to provide a postage paid method of delivery otherwise they will be deemed to not want the product and the prize will be forfeited.
We are not responsible for the shipping, we only raffle the product and as an extra and without any obligation to include it, whenever we can we will include the shipping, but if for any reason the product is lost, has extra costs of customs or otherwise we are not responsible and the product will not be refunded.
The winner can always arrange for the collection of the product if he/she wants to have control over the delivery of the product.
If the product cannot be shipped the winner is not entitled to any compensation.
The bicycle has the shipping included only in mainland Spain, for any other place the shipping and any expenses derived from it will be paid by the winner of the bicycle contest.
I.-OBJECT OF THE COMPETITION
Migou Natural health LLC with address at 30 N Gould St Ste R Sheridan, WY 82801, USA hereinafter “the Organizer”, announces the raffle of 1 used Gravel bike size M from Marc Giant and individual products of the brand Migou bcn.
II.- PROMOTIONAL PERIOD
This promotion will run from 1 January 2023 until 5 January 2024.
III.- PARTICIPANTS
The status of Participant is attributed to those who follow Migoubcn’s youtube channel and comment on the sweepstakes video (https://www.youtube.com/channel/UCwaqW8bP2Bf4B3MXsSnnhNw).
And follow Migoubcn’s Instagram account (https://www.instagram.com/migou_bcn/).
In addition, they meet the following requirements:
- Be a natural person.
- Comply with the conditions set out in these legal bases.
IV.-CONTENT AND MECHANICS
To participate in the promotion, participants must follow Migoubcn’s youtube channel and comment on the raffle video (https://www.youtube.com/channel/UCwaqW8bP2Bf4B3MXsSnnhNw).
And also follow Migoubcn’s Instagram account (https://www.instagram.com/migou_bcn/).
The promotion will run as follows:
Every time the number of followers reaches one thousand, an individual product will be raffled (not a pack of products or specific offers) of the Migoubcn brand to choose from our catalogue as long as there is stock on the web.
On 6 January 2024 the bicycle will be raffled if the youtube channel reaches 100,000 followers (if the youtube channel does not reach 100,000 followers on 6 January 2024, the raffle is automatically cancelled and the prize will not be awarded).
The mere participation in the Promotion is free, so it will not be necessary to make any purchase of Migoubcn products, although there may be additional costs to receive the product if the delivery of the product is not in mainland Spain.
If the winner of any of the raffled products wishes a delivery to a location other than within mainland Spain and is not responsible for the additional costs incurred for the delivery of the prize, customs or any other related costs, the prize will be forfeited.
V.- DRAWING
The Organiser will raffle 1 used Gravel bike shown in the raffle video in the condition it is in at the time of the raffle, if the bike suffers an accident or has a mechanical defect or failure the winner of the prize has no right to claim or financial compensation.
If the bicycle is stolen, the draw is automatically cancelled.
VI.- WINNING CONDITION
The winners of the prizes will be chosen from among all the followers of the youtube channel who have made a comment in the video of the bicycle draw that will be published on 1 January 2023.
It is an essential condition to follow the youtube and instagram channel and comment on the sweepstakes video, as the sweepstakes applications normally use these comments to obtain the winner.
VII.- NOTIFICATION AND AWARDING OF PRIZES TO THE WINNERS
1.Notification
The winner of each draw will be featured in an Instagram story and youtube video following the 6 January draw for the bike and each time the 1,000th youtube follower count is reached.
The winner will have a period of five (5) calendar days from the notification of the winner on youtube or instagram to contact us through the contact methods available on our website www.migoubcn.online .
Once the winner has contacted and/or responded to the Organiser, the Organiser will inform him/her of the conditions under which he/she must accept the prize, as well as require the winner to justify (by the means indicated by the Organiser) that he/she complies with all the participation requirements demanded in these legal bases. The winner will have a period of three (3) calendar days to justify that he/she meets the requirements and accept the prize, or if applicable, expressly reject the prize. The winner may renounce the prize won, but in no case will it be replaced by a financial amount. The prizes are personal and non-transferable, and you may not pass on your status as a winner under any circumstances.
In the event that the winner does not contact the Organiser within 5 calendar days, does not comply with the participation requirements or expressly refuses the prize, the prize will be forfeited.
2. Prize-giving
The prize will only be awarded upon presentation to the Organiser of the ID document proving identity and once compliance with the requirements of these legal bases has been verified. Once the prize has been accepted by the winner (or alternate, as the case may be), it will be delivered to the place designated for this purpose by the Organiser, who reserves the right to determine the place of delivery.
The shipping of the prize is not raffled, only the product, but as long as the winner provides a Spanish peninsular address the shipping will be free of charge for the winner.
If the prize is sent to a country other than Spain or within Spain but outside the peninsula (islands, melilla, ceuta, etc.), the winner will be responsible for the shipping and any other expenses derived from the same (customs expenses, etc.).
If the winner does not provide a shipping method to the address provided, the prize draw will be void.
The prize will be deemed to be rejected in the event that the winner does not claim the prize and arrange for the transport of the prize if necessary in compliance with the requirements within a reasonable period of time, and in any case within two weeks of acceptance of the prize.
3. Characteristics of the bike
The prize to be won in the draw is a used Giant Bicycle, you can see the bike in the video of the draw and it will always be delivered in the state in which it is on the 6th of January. In no case the good condition of the bike is guaranteed.
VIII.- TERRITORIAL SCOPE OF THE PROMOTION
The Promotion extends to the entire Spanish peninsular territory, and the prize can be claimed by any person from another region or country as long as they pay for the shipping, handling and any additional expenses derived from the transport or shipment of the product.
IX.-PROCESSING OF PERSONAL DATA
In accordance with the provisions of the applicable regulations on data protection, and specifically Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, you are hereby informed that personal data will be processed by Migou Natural Health llc, whose full identifying information appears in the heading of these Bases.
The personal data collected will be processed for the purpose of managing the participation of the contestants in the promotional action described in the terms and conditions and the corresponding tax settlements. The legal basis for the processing is the fulfilment of a contractual relationship to which the data subject is a party through acceptance of these Terms and Conditions, as well as the legitimate interest of the Organiser, with regard to advertising activities carried out by electronic means. Participants’ personal data will be kept for the duration of the promotion and thereafter only the information necessary to respond to possible claims will be stored during the legal period for the exercise of actions, or as long as the user does not express his/her opposition with regard to the advertising activities. Additional information may be requested from the winners and/or information may be transferred to collaborating entities in order to manage the provision of the prizes.
In the event that the participant so requests, their contact information will also be used to create a profile, taking into account their tastes and preferences, and to send them personalised communications about our products and services via email or on platforms and social networks where the user has a presence, the legal basis for this processing being the express consent of the participant by means of the acceptance of a check. The information related to this processing will be retained as long as the user does not withdraw this consent.
The identity of the winners may be published on the Organiser’s website, as well as on the Organiser’s social media profiles, in order to promote transparency in the process.
Participants guarantee that the personal data provided are true and are responsible for notifying the Organiser of any changes to them. The Organiser reserves the right to exclude from this promotion any participant who has provided false information.
Participants have the right to access their personal data, as well as to request the rectification of inaccurate data or, where appropriate, to request its deletion when, among other reasons, the data is no longer necessary for the purposes for which it was collected. In certain circumstances, data subjects may request the limitation of the processing of their data or object to the processing of their data, in which case the Organiser will only retain the data for the purpose of exercising or defending claims.

X. RESERVATIONS AND LIMITATIONS
The Organiser reserves the following powers relating to the development and execution of the Promotion:
- Modify or suspend the Promotion for any reason and with the commitment to communicate by means of a mention in https://migoubcn.online/sorteo-bicicleta-gravel-y-muchos-mas-productos/ the new rules and/or conditions, or if applicable, the definitive cancellation.
- The Organiser shall not be in any way responsible for any non-compliance or breach of any kind in connection with this promotion, and disclaims any and all liability for any loss suffered by participants in connection with the prize and other aspects of this promotion.
- The participant releases the Organiser from any liability and will hold the Organiser harmless from any claim as a result of damages, either to himself or to third parties, that may arise from the activity that he/she will carry out with the prize awarded.
- Expel Participants who are reasonably suspected of fraudulently manipulating or attempting to fraudulently manipulate the Promotion for their own benefit, by communication in a youtube video or instagram story.
- To take legal action against any attempt to deliberately damage the content or operation of the Promotion that is deemed unlawful.
- Prevent the establishment of speculation or business systems on the Promotion, subject to any legal action deemed appropriate for this purpose.
- The participant shall hold the Organiser harmless from any liability and indemnify the Organiser against any claim that may arise in relation to the condition or operation of the bicycle or any of its components.
- If the bicycle is stolen the draw will be void.
In no event shall the Organiser, nor its parent companies, associates, subsidiaries, affiliates or branches, nor any of their agents and/or employees, be liable for any damages and/or losses suffered by Participants and/or third parties that may arise from participation in the Promotion, or from the use of any of the prizes awarded.
XII. APPLICABLE LAW AND COMPETENT JURISDICTION
This Promotion and its Rules are governed by Spanish law. For the resolution of any controversy or dispute that may arise in relation to this Promotion, and/or with the interpretation or execution of these legal bases, both the Organiser and the Participants waive any jurisdiction that may correspond to them and expressly submit to the Courts and Tribunals of the city of Terrassa.
XIII.- TERMS AND CONDITIONS OF PARTICIPATION AND DEPOSIT OF THE SAME
Participation in the competition implies full acceptance of the contents of these rules. The competition organisers reserve the right to modify them, notifying participants at https://migoubcn.online/sorteo-bicicleta-gravel-y-muchos-mas-productos/.
Any dispute in the application of these rules will be resolved by the Organiser.
The draw will be conducted through third party applications designed for this purpose.
